LAID BACK MANOR STAY AND PLAY COMPETITION

COMPETITION TERMS AND CONDITIONS

These Terms and Conditions apply in respect of the Laid Back Manor Stay and Play Competition organised and promoted by the Promoter.

By entering the Competition, you agree that you have read, understood, and agree to be bound by these Terms and Conditions.

1.         Definitions

In these Terms and Conditions, unless otherwise provided:

  1. Adjudicator means Kylie Quilliam, Adam Marthick or any other representative nominated by the Promoter to witness and score the Entry Game;
  2. AEST means Australian Eastern Standard Time.
  3. Business Day means a day that is not a Saturday, Sunday, or a bank holiday or public holiday in Pelverata, Tasmania, Australia.
  4. Competition means the Laid Back Manor Stay and Play Competition, the details of which are set out in these Terms and Conditions;
  5. Competition UGC means any user generated content which you provide to the Promoter as part of, in connection with, or related to the Competition in any way.
  6. Competition Period means &am AEST on 1 March 2023 until 7pm AEST on 31 March 2023.
  7. Eligible Entrants mean:
    1. Australian citizens, or permanent legal residents of Australia, residing in Australia, and who are 18 years of age or older, on the date of their entry into the Competition; and
    1. who are not an officer, contractor or employee, or a relative or someone who resides with an officer, contractor or employee of the Promoter, or anyone associated with the conducting of the Competition; and
    1. who are staying at the Promoter’s Laid Back Manor accommodation for at least one night during the Competition Period, and during the time at which they play the Game.
  8. Entry Form means the entry form to be completed by Eligible Entrants at the Laid Back Manor venue before playing the Game;
  9. Entry Game means a Game arranged to be played for the purpose of entry into the Competition;
  10. Entry Method means during the Competition Period, completing the Entry Form and then completing a Game scored by an Adjudicator;
  11. Game means an 18-hole circuit golf game to be played by an Eligible Entrant on the golf course at Laid Back Manor during the Competition Period, which is scored by an Adjudicator;
  12. Judging Criteria meansthe lowest score received by an Eligible Entrant for their Entry Game, as evidenced on the Entry Game Score Cards. The score of each Eligible Entrant will be determined by the golfer’s total number of strokes taken to complete the course, whereby the lowest number of strokes taken to complete the course (as evidenced on the Score Cards) will win;
  13. Laid Back Manor means the accommodation venue and golf course located at 932 Pelverata Road, Pelverata, Tasmania, 7150.
  14. Promoter means Kylie Quilliam and Adam Marthick trading as Laid Back Manor (ABN 60 253 196 509) of 932 Pelverata Road, Pelverata, Tasmania, 7150, with contact phone number +61 418 786 154;
  15. Prize means AUD $1,000 in cash, which will be paid into a bank account in the name of the Winner (or Replacement Winner if applicable), as nominated by the Winner (or Replacement Winner if applicable) by electronic funds transfer;
  16. Replacement Winner has the meaning given to the term in clause 8(d) of these Terms and Conditions;
  17. Score Card means the score card completed by one of the Adjudicators who personally witnesses an Eligible Entrant play an Entry Game during the Competition Period, noting the Eligible Entrant’s name, contact details, time and date of commencement and conclusion of play and the score obtained for the Entry Game played by the Eligible Entrant;
  18. Total Prize Value means AUD $1,000.
  19. Winner means the Eligible Entrant with the lowest score recorded on their Entry Game Score Card who completed the Entry Method during the Competition Period.
  • Competition Period

Entries to the Competition must be submitted during the Competition Period.

  • How to Enter
  1. Entry to the Competition is open only to Eligible Entrants.
  2. In order to enter the Competition, Eligible Entrants must, during the Competition Period, perform the Entry Method.
  3. Entry must be received by the Promoter during the Competition Period. All entries are deemed to be received by the Promoter at the time of completion of the Game by the Eligible Entrant.
  4. Games for the purpose of entry to the Competition must be both commenced and completed during the Competition Period. Entry Score Cards will be signed by an Adjudicator arranged to witness the Game and note the date and time at which the Game was commenced and completed.
  5. Records of the Promoter and its agencies are final and conclusive as to the time of the receipt of an entry into the Competition.
  6. Eligible Entrants may enter the Competition once for each night in which they stay in accommodation at Laid Back Manor. For example, if an Eligible Entrant stays at accommodation at Laid Back Manor for three nights during the Competition Period, then they may enter the Competition up to 3 times during their stay (with up to one Game being played and scored by an Adjudicator for an entry into the Competition each day), provided that the entries are submitted during their stay at Laid Back Manor and during the Competition Period.
  7. No more than one Entry Game can be played on any given day during the Competition Period. For clarity and by way of example, if an entrant is staying at the Laid Back Manor for 3 nights, they cannot play 3 Entry Games on one day. Whilst they can play multiple games of golf on any given day, the results of only one Game can be used to enter the Competition each day, as prearranged with the Promoter prior to playing the Entry Game.
  8. Eligible Entrants must advise the Promoter which Game it wishes to use as its entry into the Competition prior to commencing the Entry Game. Any additional games of golf (other than pre-arranged Entry Games) played during the Eligible Entrant’s stay at Laid Back Manor will not be counted as an entry into the Competition, and will be disregarded for the purpose of the Competition.
  9. Eligible Entrants must request an Adjudicator to be present (providing at least 4 hours notice to the Promoter for the Promoter to arrange for an Adjudicator to make themselves available) for the Adjudicator to witness the Entry Game and to complete a Score Card for the Entry Game.
  10. Score cards completed by Eligible Entrants themselves without an Adjudicator will be deemed invalid and disregarded.
  11. If more than one person is staying at Laid Back Manor in a room together, and both wish to enter the Competition, they must each complete their own Entry Form, but play their Entry Game together at the same time. The Adjudicator will use separate Score Cards to record their individual results of their Entry Game.
  12. The Competition is subject to compliance with all applicable laws and regulations.
  13. Eligible Entrants must enter the Competition personally, and not on behalf of another party.
  14. The Promoter may, in its absolute discretion, but is not required to, make available at the Laid Back Manor, or publish online on its social media accounts or on its website, the lowest score attained at that time, at any stage during the Competition Period.
  • Prize
  1. The prize for the Competition isthe Prize, which is valued at the Total Prize Value.
  2. The Prize will be awarded to one Winner.
  3. The Winner is responsible for providing the Promoter with accurate bank account details into which the Prize is to be paid, within the time period required, as set out in clause 8 of these Terms and Conditions.
  4. The Promoter will deposit the Prize into the Winner’s (or Replacement Winner’s if applicable) nominated bank account within three Business Days of the Winner (or Replacement Winner if appliable) providing their bank account details to the Promoter.
  5. If more than one Eligible Entrant should score the same score during the Competition Period, then the Prize will be divided equally between those tied winners. In the event that some but not all tied winners claim the prize as contemplated under clause 8(a) of these Terms and Conditions, the full Prize will be divided equally between only those who do claim the Prize, with no Replacement Winner required to be selected in respect of those who do not claim their share of the Prize. For clarity and by way of example, if two Eligible Entrants score the same score for their Entry Game, and both claim the Prize as required herein, each Eligible Entrant would receive $500. If only one of the two winners claim the Prize as required herein, the one that does claim the Prize as required herein will receive the full $1,000.
  • Invalid Entries, Disqualification and Termination
  1. Entrants must only enter the Competition using their own personal information, and must check the relevant boxes to confirm their acceptance of these Terms and Conditions. Any entries deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the sole discretion of the Promoter, either before or after paying the Entry Game, be deemed invalid and disqualified.
  2. Any entries submitted outside of the Competition Period (or where an Entry Game commences prior to the Competition Period) will be invalid and disregarded.
  3. All entries that are incomplete (such as where they fail to complete the full Entry Game for any reason) or fail to comply with these Terms and Conditions will be disqualified from the Competition.
  4. If an Entry Game is not completed in full, such that it is disqualified from the Competition, no additional Entry Game will be available to the Eligible Entrant in replacement of that disqualified Entry Game.
  5. The Promoter reserves the right to disqualify an entry at any time if the Promoter reasonably believes that the entrant is not an Eligible Entrant or has submitted a false or misleading entry or otherwise fails to claim the Prize as set out in these Terms and Conditions if they are selected as the Winner.
  6. The Promoter may, at its absolute discretion declare any or all entries made by an entrant to be invalid if the entrant:
    1. fails to establish their entitlement to win the Prize to the Promoter’s satisfaction as required herein (acting reasonably);
    1. fails to comply with these Terms and Conditions;
    1. appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process;
    1. has, in the opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading or deceptive.
  7. If this Competition is interfered with or tampered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, strike, war, acts of God, any act of terrorism, or any other cause beyond the reasonable control of the Promotor, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    1. to disqualify any entrant; or
    1. to modify, vary, suspend, postpone, terminate or cancel the Competition, as considered appropriate by the Promoter.
  • Judging
  1. The Competition is a game of skill and chance plays no part in the selection of the Winner.
  2. Each entry will be individually judged based on its merit.
  3. The Adjudicators will choose the Winner of the Competition by applying the Judging Criteria.
  4. All Entry Forms and Score Cards relevant to the Competition will be reviewed by the Adjudicators following conclusion of the Competition Period, and the lowest score from all valid entries will be determined by 7 April 2023.
  5. The Adjudicators’ decision (in respect of both scoring Entry Games and determining the Winner from all Score Cards) is final, and no correspondence will be entered into.
  • Winner Announcement
  1. The Winner will be notified that they have won the Competition via email to the email address provided by them, and by phone to the phone number provided by them (if any), as noted in their Entry Form, by 5:00pm AEST on Friday, 7 April 2023.
  2. Unsuccessful entrants of the Competition will not be individually notified that they have been unsuccessful in the Competition.
  3. The Promoter may publish the winning Entry Game score, first name, surname initial and state of residence online and in the media.
  • Claiming the Prize and Unclaimed Prize
  1. To claim the Prize, the Winner must respond to the prize notification email from the Promoter by 5:00pm AEST on Friday, 14 April 2023, providing the Promoter with a copy of the Winner’s photo identification, the Winner’s bank account name, BSB and account number for payment of the Prize, and any other information or documentation reasonably requested by the Promoter in order to confirm the identity of the Winner, their qualification as an Eligible Entrant, and to award the Prize.
  2. Entrants should check their email inboxes (including any junk folders) for any email from the Promoter about the results of the Competition. The Promoter accepts no responsibility for the Winner failing to do so which subsequently results in their forfeiture of the Prize.
  3. If the Winner fails to respond as set out in clause 8(a) of these Terms and Conditions then the Winner will forfeit the Prize.
  4. If and only if the Winner is disqualified or otherwise fails to claim the Prize as set out in clause 8(a) and therefore forfeits the Prize, the Promoter will select a replacement Winner, being the entry with the next lowest score for their Entry Game, as set on the Score Cards completed as valid entries into the Competition (“Replacement Winner”).
  5. Any Replacement Winner will be notified via email to the email address provided by them, and by phone to the phone number provided by them (if any), as noted in their Entry Form that the original Winner was disqualified or failed to claim the Prize as required, and that they have now been selected as the winner of the Competition, by 5:00pm AEST on Monday, 17 April 2023.
  6. To claim the Prize, any Replacement Winner must respond to the prize notification email from the Promoter by 5:00pm AEST on Monday, 24 April 2023, providing the Promoter with a copy of the Replacement Winner’s photo identification, the Replacement Winner’s bank account name, BSB and account number, and any other information or documentation reasonably requested by the Promoter in order to confirm the identity of the Replacement Winner, their qualification as an Eligible Entrant, and to award the Prize.
  7. If the Replacement Winner fails to respond as set out in clause 8(f) of these Terms and Conditions then the Replacement Winner will also forfeit the Prize.
  • Personal Information
  1. In order to conduct the Competition, the Promoter will collect some personal information from you. Your entry into the Competition is conditional on you providing the Promoter with the personal information requested.
  2. The Promoter will handle any personal information collected from you in accordance with its Privacy Policy available via Privacy Policy – Laid Back Manor and these Terms and Conditions. To the extent of any inconsistency between the Privacy Policy and these Terms and Conditions, these Terms and Conditions will apply in respect of personal information collected as part of the Competition. 
  3. The Promoter may disclose your personal information to third parties in order for the Promoter to conduct the Competition and award the Prize, including but not limited to the Promoter’s employees, agents, contractors, related entities and professional advisors.
  4. By entering into the Competition, you consent to the Promoter using the personal information provided by you for the purpose of administering the Competition, awarding the Prize, publicly announcing the winner of the Competition, and any other matters related to the use of the Prize, for general ongoing promotional, marketing, publicity, research and profiling purposes, including contacting you or direct marketing the Promoter’s business and product and service offerings to you following the Competition. You may opt-out of any marketing communications using the options available in any communication sent to you by the Promoter.
  1. Publicity and Intellectual Property
  1. By entering the Competition, and regardless of whether you are declared to be the winner of the Competition, you irrevocably:
    1. consent to the Promoter using:
      1. your name; and
      1. any Competition UGC in which you personally appear or are mentioned;

in its advertising or promotion of the Competition generally, in the Promoter’s public relations and marketing and advertising of the Promoter generally, as well as the advertising of any future similar competitions conducted by the Promoter, in any medium, without any payment to you;

  • assign to the Promoter all intellectual property rights (including, without limitation, any copyright) in any Competition UGC;
    • warrant in favour of the Promoter that:
      • any Competition UGC, and the Promoter’s use of your Competition UGC in accordance with these terms and conditions will not constitute a breach of any third-party intellectual property rights; and
      • if the Competition UGC has any natural person depicted, that natural person has provided their prior written consent to be featured as depicted; and

you agree to indemnify the Promoter and its employees, contractors, officers and agents for any liability, loss, cost or expense that the Promoter or its employees, contractors, officers and agents suffers or incurs as a result of, or arising out of, your breach of this warranty; and

  • consent to the Promoter cropping, editing or altering any Competition UGC or undertaking any acts or omissions in relation to the Competition UGC which might otherwise constitute a breach of your moral rights.
  • By entering the Competition, you agree that the Promoter, or any of its employees, representatives, contractors or agents may take photograph or video content of you playing the Entry Game, and use those photographs or videos in any online, print or outdoor advertising, in any public relations content published in or on third party owned publications, platforms or sites, or on any third party accommodation booking site, to advertise the Competition, any future similar competitions, Laid Back Manor, and the Promoter’s business generally.
  • By entering the Competition, you agree that if you are declared to be the winner of the Competition, then you will make yourself available for one month after you have received the Prize, upon reasonable request by the Promoter, for reasonable media coverage and further promotion of the Competition and the Promoter generally, without expense to you.
  1. Liability
  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
  2. Except for any liability that cannot by law be limited or excluded, including, but not limited to, the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including, but not limited to, loss or damage to property, loss of opportunity or loss of profit); whether direct, indirect, special or consequential, arising in any way out of:
    1. your participation in the Competition;
    1. any entry that is received after the Competition Period;
    1. any claim of the Prize outside of the claim procedure requirements set out herein;
    1. any failure on the part of the winner of the Competition to provide any identity evidence, bank account details for payment of the Prize, or other information or documentation reasonably requested by the Promoter;
    1. unavailability or inaccessibility of the Entry Form or an Adjudicator at a particular requested time during the Competition Period;
    1. electronic or human error;
    1. an entrant failing to provide accurate or sufficient information at the time of entry or when claiming the Prize;
    1. taking of and use of the Prize;
    1. your inability to take or use any part of the Prize which it outside of the Promoter’s reasonable control;
    1. any theft, unauthorised access or third-party interference in the Competition; or
    1. any tax liability or other costs incurred by the winner of the Competition taking and enjoying the Prize.
  3. To the extent that any liability, loss or damages cannot be excluded, but can be limited, the Promoter limits its liability for them to the minimum amount permitted by law.  
  4. Entrants acknowledge that there may be inherent risks in playing the Game, and that participation in the Competition may involve participating in potentially dangerous physical activities. By entering the Competition, entrants accept that risk for themselves, and to the maximum extent permitted by law, release, hold harmless and agree to indemnify the Promoter and its employees, officers, agents and representatives from any loss, cost, claim or expense (including legal costs on a full indemnity basis) suffered by any of them which is caused by, arises out of, or is connected to, any personal injury suffered or incurred by the entrant which arises out of an inherent risk eventuating.
  5. Entrants warrant to the Promoter that they are of good physical health to play the Game when entering the Competition, and to the maximum extent permitted by law, release, hold harmless and agree to indemnify the Promoter and its employees, officers, agents and representatives from any loss, cost, claim or expense suffered by any of them which is caused by, is connected to, or which arises out of a breach of this warranty.
  1. General
  1. Entrants are responsible for any costs associated with their own stay at Laid Back Manor.
  2. There is no cost for Eligible Entrants to play an Entry Game, and no entry fee payable to enter the Competition.
  3. By entering the Competition, you expressly acknowledge that whilst the Competition may be promoted through social media platforms, it is in no way sponsored, endorsed or administered by, or associated with Meta.
  4. When participating in the Competition, you are providing your information to the Promoter. To the extent permitted by law, you release Meta from any and all liability in relation to the Competition.
  5. These Terms and Conditions are governed by the laws of Tasmania, Australia, without regard to its conflicts of laws principles. You agree to submit to the exclusive jurisdiction of the courts of the State of Tasmania, Australia.
  6. If any term, provision or condition of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the rest of these Terms and Conditions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
  7. Failure by the Promoter to enforce any of its rights in relation not the Competition at any time does not constitute a waiver of those rights.
  8. These Terms and Conditions shall be binding upon and shall inure to the benefit of the parties and their respective successors and permitted assigns.
